ISSUES
OF DIVORCE:
Allocation of Parental Rights/Child Custody
 | Residential Parent and Legal Custodian: The
parent to whom primary parental rights and responsibilities are granted by agreement or
court order |
 | Shared Parenting: Both parents have custody
of the child and are responsible for the custody and control of the child. Both parents
are considered residential or custodial parents. Shared responsibility can be agreed upon
or ordered by the court |
Child Support
 | The court may order either or both parents to
support, or half support, their children |
 | Support obligations are generally based upon
the combined incomes of both parents |
Division of
Property
 | Ohio is an equitable division state. This
means there is a division of assets acquired during the marriage based upon each partner's
equitable interest, usually 50-50. |
Alimony/Spousal
Support
 | Based upon a number of factors such as length
of marriage and contributions during marriage |
 | The court considers the needs of the
requesting party and the ability to pay of the other party
Visitation
 | Based upon the best interests of the children
and takes into consideration their age, development and any special needs

WHEN CONTEMPLATING DIVORCE:
