bulletUncontested Dissolution-may be granted:
bulletif all issues regarding children, property and spousal support have been resolved between the parties
bulletas quickly as 32 days after filing
bulletUncontested cases may be considered on a flat fee basis
bulletContested Divorce- a longer process that may result in:
bulletdepositions, hearings and a trial
bulletyears of litigation before a final resolution is reached
bulletContested cases are considered on an hourly basis. Retainer Fees are required

ISSUES OF DIVORCE:

bullet Allocation of Parental Rights/Child Custody

bulletResidential Parent and Legal Custodian: The parent to whom primary parental rights and responsibilities are granted by agreement or court order

bulletShared Parenting: Both parents have custody of the child and are responsible for the custody and control of the child. Both parents are considered residential or custodial parents. Shared responsibility can be agreed upon or ordered by the court

bullet Child Support

bulletThe court may order either or both parents to support, or half support, their children

bulletSupport obligations are generally based upon the combined incomes of both parents

bullet Division of Property

bulletOhio is an equitable division state. This means there is a division of assets acquired during the marriage based upon each partner's equitable interest, usually 50-50.
